ZONING DISTRICTS IN THE CITY OF SUNBURY

RESIDENTIAL 1 (R-1)
RESIDENTIAL 2 (R-2)
NEIGHBORHOOD BUSINESS (N-B)
CENTRAL BUSINESS (C-B)
INDUSTRIAL PARK  (I-P)

Residential 1 (R-1):

PERMITTED USES :
Single family detached dwellings, public parks, playgrounds, swimming pools, schools, museums, libraries, hospitals.

AREA REGULATIONS:
Lot area shall be not less than 5,000 square feet.
Lot coverage / Total land area occupied by the main and accessory buildings shall not exceed 40 % of the lot area.

YARDS:
Front yard shall be 25 feet
Side yard shall be 5 feet
Rear yard shall be 20 feet

LOT WIDTH:
Each lot shall have a width of at least 40 feet at the building line.  Corner lots shall be at least 20% wider than interior lots.

BUILDING HEIGHT:
No building or structure, either main or accessory use shall be higher than 35 feet.
Special Exception uses may be applied by requesting a Hearing with the Zoning Hearing Board.

Residential 2 (R-2)

PERMITTED USES:
Any use permitted in R-1 Districts, Boarding houses, adult personal care boarding houses and rooming houses.

AREA REGULATIONS:

Lot Area:   Each one-family detached dwelling shall be located on a lot not less than 3,000 square feet in an area and having a lot width of not less than 30 feet at the building line, when served by both [public water and sanitary sewers.
Each two-family dwelling shall be located on a lot of not less than 5,000 square feet in area and having a lot width of not less than 30 feet at the building line, when served by both public water and sanitary sewers.
All multiple-family dwellings, including apartments and group dwellings, shall have a lot area of not less than 6,000 square feet or 1,500square feet per dwelling unit, whichever is greater , when served by both public water and sanitary sewers.

LOT COVERAGE:
The total land area occupied by main and accessory buildings shall not exceed 60% of the lot area.

YARDS:
Front shall be 15 feet
Side: EACH side yard shall be 5 feet
Rear shall be 20 feet

BUILDING HEIGHT:
No main building or accessory use structure shall be higher than 35 feet.
Special Exception uses may be applied for by requesting a hearing with the Zoning Hearing Board.

NEIGHBORHOOD BUSINESS (N-B)

PERMITTED USES:
All uses and Special Exceptions in any Residential District, except multifamily dwelling conversion apartments.

> Retail stores, service shops and convenience stores, but excluding adult-oriented business and department stores, Banks, Offices, Studios, Medical Centers, Nursing or Convalescent homes and uses of similar character, Specialty shops for custom work and articles to be sold at retail on the premises, such as baking, confectionary, dressmaking, printing, tailoring, and similar shops and services.
> Restaurants, caf├ęs, tearooms, and other places serving food and drink.
> Telephone central offices and telegraph offices, Radio and Television studios.
> Assembly halls, Post Offices, Libraries, Fire Halls, City halls, and Similar uses, Indoor recreation centers, theaters, Billiard or Pool parlors and Bowling alleys.
> Private Schools
> Nonalcoholic bottling works.

AREA REGULATIONS:
Lot Area Width: There shall be no limit to lot area and width
Lot Coverage: There shall be  no limit to lot coverage
Yards: Side yard set back of 5 feet

BUILDING HEIGHT: No building shall be erected to a height in excess of 65 feet.

Special Exceptions may be applied for by requesting a hearing with the Zoning Hearing Board.

CENTRAL BUSINESS (C-B)

PERMITTED USES:
Same Uses as Neighborhood Business with the addition of the following:

Churches, Parish houses and Convents.
Clubs, Lodges, Fraternal Organizations.

AREA REGULATIONS:
Lot Area: None
Lot Width: None
Yards: None

BUILDING HEIGHT: No building shall be erected to a height in excess of 110 feet
Special Exception may be applied for by requesting a hearing with the Zoning Hearing Board.

INDUSTRIAL PARK (I-P)

PERMITTED USES:
All Industrial uses not otherwise prohibited by law.  Construction companies and Lumberyards.  Warehousing.  Fire halls.

AREA REGULATIONS:
Lot Area: Each lot shall be not less than ten thousand (10,000) square feet.
Lot Width: Each lot shall have a width of at least one hundred (100) feet at the building line.
Lot Coverage: The principal and accessory buildings or storage yards and loading  and unloading docks shall not project into the required yard spaces.

Open Space:

All open space, other than off-street parking lots, access drives and rail sidings, shall be covered with a vegetative material.

YARDS:
Front yard depth shall be thirty (30) feet
Side yard width shall be twenty (20) feet
Rear yard depth shall be thirty (30) feet

Buffer yard width and depth are as follows:

> When adjacent to a residential district, a buffer yard and screen planting shall be provided in addition to the above yards, the depth shall not be less than twenty-five (25) feet.  All such buffer yards and screen planting shall be provided and maintained.
> When the  Industrial district is separated from a residential district by a public street, the requirement of a buffer zone, twenty-five (25) feet in width and the screen planting may be waived by the Zoning Hearing Board.

.The space between two (2) or more structures on the same in Industrial site shall be at least thirty (30) feet in any direction.

BUILDING HEIGHT: There shall be no limit to building height.
Special Exceptions may be applied for by requesting a hearing with the Zoning Hearing Board.

HIGHWAY COMMERCIAL :

PERMITTED USES:
> Residential uses shall be permitted
> Automobile or gasoline service stations, Motor vehicle salesrooms, Major Automobile garages, Hotels, Motels, Restaurant, Drive-in restaurant, Miniature golf courses, Supermarkets, Theaters, Laundromats, Drugstores, and other similar uses in character.

AREA REGULATIONS:
Lot Area and Width: There shall be no limit to lot area and width.
Lot Coverage: The coverage shall be no more than 60%

YARDS:
Front Yard: None required
Side Yards: two (2) : width, ten (10) feet each side of a principal building, provided that commercial structures do not abut side by side; however, no side yard shall be required where two (2) or more commercial uses abut side to side.  In the case of a series of abutting structures abutting and paralleling a public right of way, an open and unobstructed passage for vehicles and pedestrians, of at least twenty (20) feet in width, shall be provided at grade level at intervals of not more than four hundred (400) feet.
Rear Yard Depth: Shall be twenty (20) feet.
Buffer Yard: Along any residential district boundary line, a buffer yard shall be provided which shall be not less than twenty- five (25) feet in width, measured from such boundary line, except where such boundary line is a street line.  No buffer shall be required when a street separates the commercial district from a residential district.

BUILDING HEIGHT: The building height shall be no greater than thirty-five (35) feet 
 
NEW ORDINANCES:

NEW RENTAL PROPERTY ORDINANCE:

Article XVII 175-114 1.o to 11.0 - Change to resolution on (EFFECTIVE DATE  November 26, 2007).

Any Person who intends to create a NEW RENTAL PROPERTY, must apply for an application with the Code Administration Office.  The Fee for the Application (FAST TRACK APPLICATION) is $1,000.00 per Unit and the Housing Permit fee of $50.00 must be paid for prior to the Inspection of the unit.

The Fast Track Approval Process is as follows:

(1) A single family home, which will remain as a single family home.

(2) A half (1/2) double home, which will remain as a half (1/2) double.

(3) A single family Townhouse converted from a single family Townhouse rental Unit.

(4) A rental unit located as part of a commercial structure in the CENTRAL BUSINESS DISTRICT with a minimum of 1,200 square feet of living space.  (The living space would include separate rooms for cooking, sleeping, living rooms and an overall use by one family as opposed to a boarding house facility.)  The commercial space must remain in the portion of the property that existed immediately prior to filling the application.

There must be Off Street Parking of at least 1.5 spaces per rental unit.

If the Property will not meet the above mentioned Fast Track Approval you will need to have a Zoning Hearing the cost is ($300.00) also the application fee will need to be remitted ($1,000.00) along with the Housing Permit ($50.00).

Any owner of a property which has not been listed as a RENTAL PROPERTY and is CAUGHT RENTING the PROPERTY will need to Submit an additional fee of ($2,500). along with the application fee and housing permit.


Chapter 130 Ordinance 1157 Section O  801.2 and P 801.3 (Wording Change)

Section O PM 801.2: Disposal of rubbish: Disposal of rubbish shall be removed on a weekly or more frequent basis.  The Owner and or operator of any property with in the City limits shall be required to show to the Code Administration Office proof of a disposal service or method of removal for the property.

Section P 801.3: Disposal of garbage: Disposal of garbage shall be removed on a weekly or more frequent basis.  The owner or operator of any property with in the City limits shall be required to show to the Code Administration Office  proof of a disposal service or method of removal for the property.
