Commercial Property Inspection Public Meeting and Ordinance Update

On February 28, 2022 from 5:15pm-6:15pm there will be a public work session with NEIC (third-party commercial property inspectors) for citizens or property owners who have questions regarding the commercial property inspection ordinance. Individuals are encouraged can come and ask any specific questions to our third-party inspectors (NEIC) related to the subject.

The Mayor, Director of Code Enforcement and Staff met with our third-party commercial property inspectors discuss making changes to the current ordinance.

These amendments will include the following ideas:

A. The Ordinance will be recreated with the sole purpose of preventing eminent danger and ensuring life safety of all; and,

B. The Ordinance will contain clear and unequivocal language ensuring that any currently standing building is subject to “Grandfathered” status, and that no “new” safety equipment such as sprinkler systems or ADA compliance shall be applicable thereto absent the occurrence of significant new construction thereon.

C. No structure shall be subject to Commercial Inspection if said structure has been inspected for structural safety within the prior three (3) year period by any local, state, or federal agency, subject to written proof thereof.

D. No structure shall be subject to Commercial Inspection if said structure is subject to Residential Rental Compliance inspections.

E. If any structure has been the subject of an occupancy inspection within the prior three (3) year period then said structure will be prorated reduced Commercial Inspection fee.

F. That any and all commercial property owners will receive via mail an Application for Exemption from the City whereby they will acquire exempt status if any of the aforementioned contingencies for exemption are met.
